Terms of Service

1. Use of Service

Musha provides an online platform for listing, searching, and transacting property in Zimbabwe. By accessing or using the platform, you agree to these terms. You must be at least 18 years old and legally competent to enter into contracts. The platform is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time without prior notice.

2. User Accounts

You must register with accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorised use. We reserve the right to suspend accounts that violate these terms or are associated with fraudulent activity.

3. Property Listings

Property listings must be accurate, lawful, and not misleading. Sellers and agents must have legal authority to list the property. All listed agents must hold a valid Estate Agents Council licence. We reserve the right to remove listings that violate our guidelines, contain false information, or misrepresent the property. Listing fees are non-refundable once a listing is published.

4. Payments

All payments are processed through licensed Zimbabwean payment providers (EcoCash, InnBucks, OneMoney) or international processors (Stripe). Musha does not hold client funds directly. Rent payments, deposits, and service fees are processed as instructed and subject to the terms of the relevant payment provider. Disputes regarding payments should first be directed to the payment provider, then to Musha support.

5. Agent Verification

Agents displaying the EAC Verified badge have been confirmed against the Estate Agents Council of Zimbabwe register. Verification status is checked periodically but Musha does not guarantee the ongoing validity of an agent's licence. Users are encouraged to independently verify an agent's credentials before engaging their services.

6. Diaspora Services

Diaspora investment services including due diligence, virtual inspections, and remote purchase assistance are provided subject to Zimbabwean property law and foreign exchange regulations. Musha acts as a facilitator and is not a licensed financial adviser. Users should seek independent legal and financial advice before making investment decisions.

7. Limitation of Liability

Musha is a platform that facilitates connections between property stakeholders. We are not a party to any transaction between users and do not guarantee the outcome of any deal. To the maximum extent permitted by law, Musha shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the platform, including but not limited to property disputes, financial losses, or agent misconduct.

8. Dispute Resolution

Disputes between users should first be addressed between the parties. If unresolved, users may submit a formal complaint through the platform. Musha will mediate in good faith but is not an arbitral body. Disputes not resolved within 30 days may be referred to the Estate Agents Council or the Zimbabwean courts as appropriate.

9. Changes to Terms

We may update these terms periodically. Material changes will be communicated via email or platform notification at least 14 days before taking effect. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
